Florida Statute 163.045: Your “Get Out of Jail Free” Card for Dangerous Trees

February 9, 2026
4–6 minutes

Understanding Florida Statute 163.045 is the key to protecting your property from hazardous trees without the headache of city permits. If you’ve lived in Florida for more than a few years, you know the drill: You have a tree that’s leaning dangerously over your house. You know it’s a hazard. But the thought of driving down to City Hall, paying $150 for a permit, and waiting three weeks for a clerk to tell you “maybe” is enough to make you just hope for the best during the next storm.

Well, we have some good news for you. Since the update to Florida Statute 163.045, the power has shifted back to the homeowner.

Understanding FL Statue 163.045: Your Legal Shield

In the past, Florida municipalities often held all the cards. If you had a massive Oak with a split trunk looming over your nursery, you were often at the mercy of a weeks-long permitting process and expensive “mitigation fees”—money the city forced you to pay just for the right to protect your own home.

Florida Statute 163.045 changed the game by prioritizing safety over red tape. This law explicitly prohibits local governments from requiring a permit, application, or fee for the removal or pruning of a tree on residential property, provided the tree poses an “unacceptable risk.” By shifting the authority away from city hall and into the hands of homeowners and experts, the state has ensured that safety decisions can be made in hours, not weeks.

How Florida Statute 163.045 Works for Homeowners

While the law gives you incredible freedom, it isn’t a “wild west” scenario where you can remove any tree for any reason. To enjoy the protections of the statute and avoid heavy local fines, you must follow a specific, legally-backed process.

  1. The Expert Determination
    • The law doesn’t care if a neighbor thinks a tree looks “scary.” For the statute to apply, you must obtain documentation from an ISA Certified Arborist (like our team) or a Florida Licensed Landscape Architect. This professional must conduct an onsite assessment and formally conclude that the tree is an “unacceptable risk” to persons or property.
  2. Defining “Unacceptable Risk”
    • What constitutes a real hazard? We use the ISA Best Management Practices for Tree Risk Assessment to make that call. We look for:
      • Likelihood of Failure: Visible rot, internal decay, or significant structural defects like “V-shaped” trunk inclusions.
      • The Target: If the tree (or a major portion of it) were to fall, is there a high probability it would hit your home, a power line, or a public right-of-way?
    • If removal is the only practical way to lower that risk, the statute is triggered, and the city’s permit requirements are officially bypassed.
  3. Protection Against “Mitigation” and Fines
    • This is where the “meat” of the law really helps your wallet. Under Statute 163.045, if your tree is documented as a hazard, a city cannot force you to:
      • Pay for a removal permit.
      • Plant “replacement trees” to make up for the one you removed.
      • Pay into a “Tree Canopy Fund” as a penalty

THE BOTTOM LINE: You have the right to a safe home. By combining the power of Florida law with a professional arborist’s documentation, you can bypass the bureaucracy and handle your tree hazards on your own terms.

Pro-Tips from Our ISA Certified Arborists

What is an “Unacceptable” Risk?
An unacceptable risk doesn’t just mean the tree looks “scary.” It means there is a high likelihood of a part of the tree failing (due to rot, structural defects, or disease) and a high likelihood that it will hit a “target” (your roof, your neighbor’s house, or a public walkway).

Why this is a Game-Changer for 2026

With the 2026 storm season approaching, the last thing you want to be doing is waiting on a permit while a tropical depression is churning in the Gulf.

Using the Statue Saves you:

  • Time: No waiting 14-30 days for a city inspector to show up.
  • Money: No permit application fees or “mitigation” costs where the city forces you to plant three new trees just to remove one dead one.
  • Stress: You have the legal right to protect your home immediately.

Don’t “Self-Diagnosis” Your Trees

While this law gives you freedom, it also places the responsibility on you to have the right paperwork. If you remove a tree claiming it was dangerous, but you don’t have a signed letter from a Certified Arborist, the city can still fine you heavily.

At Napoleon Tree Service, we don’t just cut trees; we provide the professional assessment needed to keep you compliant with state law. We’ll look at the root structure, check for internal decay, and provide the documentation that serves as your legal shield.

Arborists, not Attorneys

We’re experts at diagnosing root rot and structural defects, but we don’t wear suits to court for a reason. While we know Florida Statute 163.045 inside and out as it pertains to tree safety, this post is for informational purposes only and does not constitute legal advice.

Every property and local situation is unique. Because laws and local interpretations can change, we always recommend consulting with a licensed attorney for specific legal questions. We’ll handle the chainsaws; you handle the lawyers!
